Counter-Notification
If you believe that the material you posted was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with us by providing the following information to the copyright agent identified above:
- Your physical or electronic signature
- Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access to it was disabled
- A statement from you under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the courts in your location and that you will accept service of process from the person who provided notification of the alleged infringement
Repeat Infringer Policy
In accordance with the DMCA and other applicable law, Tarvion has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to our website and services or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
Response Timeline
Upon receipt of a valid DMCA notification, we will:
- Remove or disable access to the allegedly infringing material
- Notify the user who posted the material that we have removed or disabled access to it
- Take reasonable steps to promptly notify the alleged infringer of the complaint
If we receive a valid counter-notification, we will forward it to the party who submitted the original claim of copyright infringement. The original complainant will then have 10 business days to notify us that they have filed legal action relating to the allegedly infringing material. If we do not receive such notification, we may restore the material.
False Claims
Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability. We reserve the right to seek damages from any party that submits a notification or counter-notification in violation of the law.
Educational Use and Fair Use
Tarvion provides educational content and resources for learning purposes. We respect fair use principles and encourage users to do the same. Educational materials, commentary, criticism, and transformative works may be protected under fair use doctrine. However, this does not exempt users from complying with copyright law or this DMCA policy.
